Description

Our project will bring together jurists, legal and political philosophers, intellectual historians and political theorists to examine the historical and philosophical origins and foundations of the European Convention on Human Rights and, in particular, the intellectual influence of natural law, ancient Greek philosophy and Christian intellectual traditions on its conception and drafting.

We will use the intellectual resources of these traditions to offer a fresh critique of the status quo of the Convention system and the jurisprudence of the European Court of Human Rights. Building on these critiques, we hope to articulate new approaches to judicial interpretation and doctrine in light of interdisciplinary research on the natural law tradition and its understanding of rights, the common good, human flourishing, judicial power, and human dignity.

We aim to critically assess the European Convention on Human Rights and European Court of Human Rights from a classical legal theory framework. We will bring together jurists and political theorists for a series of symposia and workshops on this topic, with a view to publishing the proceedings for public dissemination so that they might inform ongoing debates about the Convention and role of the Court.
